Terms of Service

1. Eligibility

You may use the Site only if you can form a binding contract under applicable law. You must be at least 18 years old (or the age of majority in your state) to create an account, place a paid order, or book a paid event. Visitors under 18 may use the Site only with the involvement of a parent or legal guardian.

2. Your account

• You are responsible for keeping your login credentials confidential and for all activity under your account.
• The information you provide must be accurate and current. Please update it if it changes.
• One account per person. Don’t share, sell, or transfer your account.
• Tell us promptly at hello@laughingmonkcafe.com if you suspect unauthorized access.
• We may suspend or close accounts that violate these Terms or applicable law.

3. License to use the Site

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Site for your own personal, non-commercial use in connection with our restaurants. You may not copy, scrape, reverse-engineer, or build a competing service from the Site, our content, or our brand assets without our prior written permission.

4. Reservations and walk-ins

Reservations at participating locations are handled through Tock or another reservation provider, and are subject to that provider’s terms in addition to ours. Some experiences require a deposit or prepayment; the specific cancellation window and refund policy is shown at the time of booking. Please read our booking policy for current details.

Walk-ins are welcome based on availability. Tables not claimed within 10 minutes of the reservation time may be released to other guests.

5. Events and ticketing

Some events sell tickets through Eventbrite or another ticketing partner. Their terms apply to tickets purchased through them. Unless stated otherwise on the event page:

• Tickets are non-refundable once an event has begun, except as required by law.
• We may reschedule or cancel an event for safety, weather, or operational reasons; in that case, ticketed guests will be offered the option to attend the rescheduled date or receive a refund.
• Doors and start times are approximate and may shift slightly.
• We reserve the right to refuse entry or remove guests for unsafe or disruptive behavior, with no obligation to refund.

6. Online ordering

Online ordering at order.laughingmonkcafe.comis operated by AppFront. Orders, payment, delivery, and any loyalty rewards are governed by AppFront’s and the delivery partner’s terms. We are not responsible for transactions, payment disputes, or delivery issues that arise on those platforms; please contact the platform directly first, and reach out to us if you can’t resolve it.

7. Gift cards and gift certificates

Gift cards and gift certificates issued by Laughing Monk Cafe are redeemable for food and beverage at participating Mission Hill and Wellesley locations. Consistent with Massachusetts law, gift certificates issued in Massachusetts do not expire and are not subject to dormancy or service fees. Gift cards are non-reloadable, are not redeemable for cash (except as required by law, including Massachusetts G.L. c. 200A § 5D for balances under $5 after partial redemption), and lost or stolen cards cannot be replaced unless we can verify purchase.

8. Payments

When the Site processes a paid event booking, payment is handled by a PCI-compliant processor such as Stripe or Authorize.net. We do not store full card numbers on our servers. By submitting payment information you represent that you are authorized to use the payment method and agree to the processor’s terms.

9. Marketing emails and SMS

By subscribing to email or SMS, you agree to receive recurring messages from Laughing Monk Cafe at the email address or phone number you provide. Message and data rates may apply to SMS. Frequency varies. You can opt out of email at any time using the unsubscribe link in any campaign, and out of SMS by replying STOP; reply HELP for assistance. Consent to marketing is not a condition of any purchase.

10. Food allergies and dietary information

Our kitchens prepare dishes containing common allergens including peanuts, tree nuts, soy, dairy, eggs, wheat/gluten, fish, and shellfish. While we take reasonable steps to honor dietary requests, we cannot guarantee that any item is free from cross-contact with allergens. If you have a serious allergy or dietary restriction, please tell our team before ordering so we can advise. The dietary tags shown on the Site (vegetarian, vegan, gluten-friendly, etc.) are guidance only and may change with seasonal menus.

11. User submissions

If you submit content to us — feedback, suggestions, photos in a contact form, performer materials — you grant Laughing Monk a non-exclusive, royalty-free, worldwide license to use that content in connection with our business (for example, to respond to you, evaluate a booking, or, where you have given us specific permission, to share on our channels). You represent that you have the right to submit the content and that it does not violate anyone else’s rights.

12. Intellectual property

The Site, including its design, text, photography, logos, and the “Laughing Monk Cafe” name and related marks, is owned by Golden Naga, Inc. or licensed to it, and is protected by copyright, trademark, and other laws. Except as expressly permitted in these Terms, you may not use our content or marks without our prior written consent.

13. Prohibited conduct

You agree not to:

• Use the Site for any unlawful purpose or to violate anyone’s rights.
• Attempt to gain unauthorized access to accounts, systems, or networks.
• Interfere with or disrupt the Site (denial of service, scraping that overloads servers, malware, etc.).
• Reverse-engineer, decompile, or otherwise attempt to derive source code from the Site.
• Use bots, scrapers, or automation tools to access or collect data from the Site, except for well-behaved search engines and similar public-interest crawlers.
• Post or transmit content that is unlawful, harassing, defamatory, infringing, or harmful.
• Misrepresent your identity or pretend to be someone else.

14. Disclaimers

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT MENU ITEMS, PRICES, HOURS, AND OTHER INFORMATION ON THE SITE WILL ALWAYS BE COMPLETE OR ACCURATE.

15. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LAUGHING MONK CAFE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, GOODWILL, OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE SIX MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.

16. Indemnification

You agree to indemnify and hold harmless Laughing Monk Cafe, Golden Naga, Inc., and their officers, directors, employees, and affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of (a) your use of the Site, (b) your breach of these Terms, or (c) your violation of any law or third-party right. We reserve the right to assume the exclusive defense of any matter for which you have agreed to indemnify us.

17. Governing law and venue

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws principles. The exclusive venue for any dispute that is not subject to small claims jurisdiction is the state or federal courts located in Suffolk County, Massachusetts, and you and we each consent to personal jurisdiction there. Nothing in these Terms limits any non-waivable rights you have under applicable consumer-protection laws.

18. Changes to the Site or Terms

We may update the Site and these Terms from time to time. When we make material changes we will update the “Effective” date and post the updated Terms here, and we may also notify subscribers by email. Your continued use after changes become effective means you accept the updated Terms. We may also modify, suspend, or discontinue any part of the Site at any time, without liability.

19. Severability and entire agreement

If any part of these Terms is found unenforceable, the rest will remain in effect. These Terms, together with our Privacy Policy and any other terms we link from a specific page or service, are the entire agreement between you and us about the Site, and supersede any prior understandings on the same subject. Our failure to enforce a provision is not a waiver of our right to enforce it later.
